If a German statutory health insurer says your coverage ended and later sends a retroactive contribution bill, first identify the exact decision, the dates and the membership category the insurer applied. Ask for the written notice, the contribution calculation and the records it relied on. If the document is a formal administrative decision, check the objection instructions and deadline immediately. Do not infer from a phone call, a card, or a bank debit alone that you were or were not insured for a particular period.

This guide is about the statutory health insurance system (gesetzliche Krankenversicherung, or GKV) in Germany. It does not decide whether an individual insurer acted lawfully, whether a particular person owes a contribution, or whether treatment should have been refused. Employment, student status, residence, existing insurance entitlement, dates and cross-border rules can change the analysis. A nationality label alone does not determine the answer.

Separate the notice, membership period and contribution amount

A letter can contain more than one issue. The insurer may state that membership began or ended on a date, classify the person as an employee, student, voluntary member or another category, and assess contributions for one or more periods. Write each statement into a separate row before responding. Do not treat a card renewal, an insurance confirmation or a contribution debit as a substitute for the reasoned written decision.

Ask the insurer to identify the exact document it relies on. Is the payment demand a formal Bescheid (administrative decision), an invoice, a reminder, or a preliminary calculation? Request a complete copy if you have only received a summary or telephone explanation. Record the date the notice was received and keep the envelope or electronic delivery details. Read the Rechtsbehelfsbelehrung, the section that explains legal remedies, and ask a qualified adviser to confirm the deadline and how to file.

The German Social Courts Act, § 84 SGG, generally provides one month from notification of an administrative act to submit an objection (Widerspruch). It provides three months where notification is made abroad. The applicable date is not necessarily the day you opened a letter, and rules about service, form, holidays and missing or incorrect remedy instructions may matter. If a deadline may be approaching, get advice promptly rather than waiting for the insurer to complete an informal review. A request for more information may not preserve a formal deadline. Also, an objection generally does not suspend enforcement of decisions on insurance or contribution duties or contribution demands. Under SGG § 86a(2)(1) and (3), an authority may suspend enforcement in specified cases and should do so where serious doubts exist or enforcement would create an unfair hardship not justified by overriding public interests. Whether those provisions apply to a particular document and what step to take depends on its legal form and facts; seek prompt qualified advice rather than assuming payment is paused.

Map the dates before discussing the amount

Create a simple timeline with the first day of each relevant period. Include the German move-in or registration date, every job start and end date, the university semester and enrollment dates, any change from employment to study, the date insurance was confirmed, each contribution debit, each request for documents, the date a notice was sent and when it reached you. If a period crosses a month or semester boundary, do not combine it into one estimated range.

Use documents to support each date. Useful records may include employment contracts and termination letters, payroll statements, university enrollment certificates, proof of residence, insurer letters, bank records and any foreign insurer’s confirmation of coverage. Keep original files and a copy of each document as it was sent. A bank debit can show that an amount was collected on a date; it does not alone establish what legal category applied or whether the following month was covered.

Check which category the insurer says applies

German statutory rules distinguish people who are compulsorily insured because of employment from students and other insured groups. SGB V § 5 lists categories, including employees and certain enrolled students, with conditions and exceptions. SGB V § 186 addresses when several categories of compulsory membership begin. For example, the statute sets a start rule for employed persons and a separate start rule for insured students tied to the academic term and enrollment. These provisions do not establish which category applied to a particular person without the underlying facts.

Ask the insurer to state the category it applied for every disputed period and the reason it used that category. If you worked before enrolling, provide the job dates and payroll records. If a job ended before student coverage began, ask the insurer to show how it treated the transition dates and what happened between them. If the insurer says that membership was voluntary, ask for the decision and calculation that support that treatment. SGB V § 240 addresses contribution assessment for voluntary members, including the treatment of income evidence; the details depend on the applicable rules and records.

A student card, a university certificate, or the label “working student” is not by itself a full insurance analysis. The type of enrollment, age-related statutory conditions, employment, existing entitlement to benefits from another state, residence and coordination rules may all matter. Do not assume that a person is exempt merely because they study, or that a German insurer can charge the same way for every student.

Treat cross-border history as a separate evidence question

If you previously lived or were insured in another country, ask the German insurer to identify exactly what evidence it requested. Was it asking for proof that you were covered, a document confirming the dates, evidence that you were entitled to benefits while living in Germany, or something else? Ask why it believes that a foreign document changes the German membership category or contribution period. Keep the request, your reply and any translation.

The National Association of Statutory Health Insurance Funds’ DVKA guidance on students explains that foreign coverage can matter, but whether an entitlement to benefits is sufficient depends on the foreign country, the person’s centre of life, whether the stay in Germany is temporary for study, and whether they work in Germany. It separately describes EU, EEA and Swiss situations. These are conditional examples, not a rule that a particular student is covered or exempt. Switzerland’s social security coordination and Croatian or other EU rules can differ. Get advice about the actual countries, dates, employment and prior insurer.

Request a certificate from the previous insurer that states the person’s name, coverage dates, type of coverage and, if available, the period during which benefits could be claimed in Germany. Ask whether the German insurer requires an official form or a particular issuing authority. If the foreign insurer has already sent material, ask the German insurer to identify which documents it received and what remains missing. Do not send an unrelated foreign record that does not prove the period or entitlement at issue.

Respond to a formal bill without losing the timeline

If the notice includes an objection deadline, record it immediately and ask a German social-law adviser to check the period and filing requirements. A person may need to file an objection even while gathering fuller reasons or documents. Do not assume an email, phone call, complaint to a service centre, or promise to call back pauses the statutory period. The notice’s instructions and current procedural law control the filing route. Missing or incorrect remedy instructions can affect the time limit, but the statutory rule has its own exceptions; do not rely on an assumed extension.

In a written response, identify the reference number, the date of the notice, the period you dispute and the specific factual issue. Ask for the complete calculation and a list of records the insurer considered. If you believe the insurer used an incorrect nationality, residence or prior-insurance assumption, state the correction and attach records that support the actual dates. Avoid a broad statement that the whole bill is invalid unless a qualified adviser has reviewed it.

If you agree with some dates but not others, say so clearly and ask for a period-by-period account. Do not treat the amount shown as self-explanatory. The insurer may have applied an assumed contribution basis because a required income document was missing; SGB V § 240 includes rules for voluntary-membership contribution assessment when proof is not provided and for later adjustment in certain circumstances. That provision does not show that it was applied in a particular case. Ask the insurer which rule and figures it used.

If a treatment appointment is affected, separate the immediate care question from the contribution dispute. Contact the health insurer in writing to ask whether membership and benefits are active for the date of care, what confirmation the provider can use, and how to correct any card status. Contact the provider to explain that you are seeking written confirmation. A later contribution bill and a card status may not answer the same question. If care is urgent, use the appropriate medical service rather than waiting for an informal billing response.

A focused written request

You can adapt this fictional example, changing it to match your records:

Please send me the formal written decision and calculation for the contribution demand dated [date], including the membership category and coverage dates applied for each period. Please identify the legal and factual basis for the end date you state, and list the foreign-insurance evidence you requested and the documents received. I am obtaining records for the periods [dates]. Please confirm in writing whether my membership and benefits are active on [care date]. I am separately checking the objection instructions and deadline shown in the notice.

Only include facts that are true. Keep a copy of what you send, attachments and delivery confirmation. If the insurer responds by phone, send a short written recap and ask it to correct anything inaccurate. Keep an index that shows which file proves which date. Gotham’s legal case intake workflow can help organize the issue list and chronology. The litigation document organization guide covers a neutral evidence index. If the question is whether an employee or contractor classification is accurate, our separate Germany employment-status evidence guide covers employment-status records, not health insurance eligibility. Before accepting or challenging a contribution calculation

Check that the notice names the correct period, category, contribution basis and reason for any assumed income. Confirm whether the insurer is relying on a foreign insurance certificate, a missed request for information, a transition between work and study, or a statutory membership rule. Ask for the exact document it says was sent and when. Compare it with your address and delivery records.

Do not throw away the original notice, ignore a deadline because you are waiting for another insurer, or assume that a debit or card proves every legal fact. Do not accept that a large amount is correct just because it appears on an official-looking page. If you do not understand the legal remedy section, obtain qualified German advice. Where cross-border status is involved, seek advice from someone who can assess both the German rules and the coordination rules applicable to each country.

Questions about a German health insurance contribution notice

Does being a student automatically mean student health insurance applies?

No. The German Social Code sets conditions for compulsory insurance as a student, and other insurance status or foreign benefit entitlements can matter. Enrollment alone does not resolve every person's status.

Can a health insurer cancel coverage retroactively?

A verbal description such as “cancelled” does not identify the legal act or its effect. Ask for the written notice, the exact decision date, the period affected, the factual and legal reasons, and the remedy instructions. A qualified adviser can assess the decision against the records.

How long do I have to object to a German statutory health insurance decision?

The Social Courts Act generally sets one month from notification of an administrative act for an objection, and three months where notification is made abroad. If remedy instructions are omitted or incorrect, a generally applicable one-year limit may apply under § 66(2), subject to exceptions. An objection to a decision on insurance or contributions generally does not suspend enforcement; seek advice promptly about any request to suspend enforcement.

Does a new health card prove that I was insured for an earlier period?

Not by itself. Ask the insurer to confirm in writing the membership category and coverage dates, and how those dates relate to any contribution assessment. A card or a past debit does not answer every question about a later period.

What if the insurer says I was required to show insurance in another country?

Ask which country, dates, type of entitlement and proof it requires, and why that evidence affects the German insurance category at issue. Foreign coverage and cross-border coordination can be complex, so do not assume that nationality or a previous country of residence alone decides the result.

General information, not legal advice. This guide concerns German statutory health insurance only. A person's membership, contribution category, start and end dates, cross-border coordination and remedies depend on the exact work, study, residence, coverage and notice facts.
