If your college or university is holding your original academic degree certificates, first identify the institution, your role and the exact documents being held. Education-sector materials address teachers' originals, but their scope is not identical. The University Grants Commission (UGC) issued a 2020 public notice about higher-education institutions retaining teachers' academic certificates. The All India Council for Technical Education (AICTE) addresses faculty degree certificates in its Approval Process Handbook for 2024–25 to 2026–27. Neither source should be turned into a universal rule for every employer or every document.
This guide concerns a teacher's own academic originals held by an employing higher-education institution. It does not cover school teachers, student-admission documents, non-teaching staff, ordinary commercial employers or every item someone might call an “original.” For an individual dispute, check the current official text and get advice specific to the institution and employment terms.
Identify the document and who holds it
Write down exactly what the institution has: degree certificates, mark sheets, experience records, identity documents or something else. Note whether it asked to inspect an original, took temporary custody or says it will retain the document as a condition of joining or leaving. These are different situations. AICTE's handbook refers to faculty members' Original Degree Certificates, while the UGC public notice uses broader language about teachers' academic certificates and documents.
Identify the legal and administrative relationship as well. Is the institution a university, a college affiliated to a university, or a technical institution? Who is named as your employer in the appointment letter? Which programme and campus are involved? The institution's description alone may not establish which regulator's rules apply. These details help you ask the right office and avoid relying on a source outside its scope.
Collect the appointment or employment contract, any document receipt or inventory, messages explaining why the originals were collected, and any prior request for their return. Keep a dated timeline somewhere you control. If the institution needs to verify a qualification, ask whether you can show the original for inspection and take it back, while providing a copy for its records. Do not send scans of sensitive identity details to an unverified contact.
What the UGC public notice says
The UGC public notice dated 11 August 2020 is titled “Non Retention of Certificates of Teachers by Higher Educational Institutions.” It addresses higher-education institutions collecting original academic certificates and mark sheets from teachers when issuing employment contracts and continuing to retain them. The notice says employing higher-education institutions should not keep a teacher's academic certificates or documents in original and refers to employment contracts setting out terms and conditions in accordance with UGC and other applicable statutory-body norms.
The notice is about teachers and employing higher-education institutions. It does not establish a general rule for every worker in India or every employer outside higher education. A copy of the notice can be read here; it identifies UGC, file number F.No.14-12/2019(CPP-II), and the date. The UGC annual report for 2020–21 also records the notice. For a live dispute, confirm its current status with UGC or the institution and a qualified adviser. This guide describes the dated notice and does not decide whether a particular institution or employment arrangement is covered.
What the AICTE handbook says about faculty
The AICTE Approval Process Handbook for 2024–25 to 2026–27 contains provisions specifically addressing faculty in technical institutions. Section 6.14(b) says the institution should not demand faculty members' original degree certificates at the time of joining, except for verification. The text distinguishes checking a qualification from keeping its original certificate.
Section 7.4(k) addresses institutional conduct and faculty leaving during a semester. It says that when a faculty member intends to leave mid-semester without sufficient notice for an alternative arrangement, the member may complete the assigned course syllabus in view of students' academic interests; it then states that, in any case, the institution shall not retain faculty members' original degree certificates. The provisions address different concerns: continuity of teaching and custody of original documents.
Read the wording in its context and confirm whether the institution and programme are within AICTE's scope. AICTE also issued a 2025–26 addendum/corrigendum to the 2024–27 Handbook, a later academic-year update to consult alongside the main text. Check the official source for any further updates before relying on a clause. Do not infer a particular penalty or guaranteed outcome from these provisions alone. They also do not resolve notice-period, contract, salary, handover or other employment disputes.
Make a calm written request
Send a concise request to the office or person that acknowledged receiving the documents. Copy HR or the registrar if appropriate. Keep the tone factual and retain the sent message, delivery confirmation and any ticket number. List each original separately and include when and by whom it was handed over, if known. Ask where the documents are held and propose a practical collection arrangement.
You can write: “I am requesting return of my original [list each document]. They were provided to [office or person] on [date, if known]. Please confirm where they are held and how I can collect them. If the institution believes a particular document must remain with it, please explain the reason and the applicable written policy. I can arrange a convenient collection and bring copies for verification if needed.”
If the institution says it needs to verify a qualification, ask whether the original can be inspected and returned during the same appointment. The AICTE handbook's joining provision expressly refers to verification, but that limited wording should not be generalized to every institution or every document. If you have left or are leaving, state your last working date and offer a reasonable collection option. Keep the certificate request separate from a disagreement about notice, handover, final pay or course completion.
If the institution refuses or does not respond
Ask for the institution's position in writing. Request the reason for retaining each original, the contract term or policy it relies on, and the office handling the request. A written response helps clarify whether the issue concerns verification, an internal process or a separate employment dispute.
Next, check the staff grievance or employee complaint route published by the institution and the applicable employment documents. Do not assume that a student grievance channel is the right one for an employee. Keep the complaint, attachments, ticket number and response together. If the employer is a technical institution, confirm the relevant AICTE handbook provisions and institutional approval status through official channels. For other higher-education institutions, check the current UGC direction and any state or statutory requirements that may apply.
There is no single nationwide filing forum, return deadline, compensation amount or remedy established by the sources described here for every teacher and every institution. Ask the relevant regulator or a qualified Indian education or employment lawyer to identify the correct route before filing a formal complaint. If the institution links return of documents to a bond, notice period, salary, handover or disciplinary matter, bring the appointment letter, document inventory, written requests and replies to an adviser. The certificate question may overlap with contractual or service issues that require separate analysis.
Keep a usable evidence record
Maintain a chronology with the date each document was submitted, who received it, when you requested its return, how the institution responded and any collection appointment offered. Preserve the original receipt, email headers, messages and delivery acknowledgements. If the institution provides a collection record, check that it lists each item returned before signing or keep a copy with any correction you make.
Share only the information needed through verified institutional channels. If you must send a copy of an appointment letter or identity document, redact unrelated personal information where appropriate. Keep a separate copy of every submitted attachment. The guides on employment bond enforceability in India and delayed salary while employed discuss separate employment issues. For a related document-management process, Gotham's workflows describe ways to organize records and follow-up; they do not determine whether a legal rule applies.
Quick checklist
- I listed each original separately and identified who received it.
- I checked who employs me, what kind of institution it is and which programme is involved.
- I am asking about my own academic documents as a teacher, not relying on student-admission or general-employment rules.
- I made a calm written request and kept proof of delivery.
- I asked for the institution's reason and any policy in writing.
- I separated certificate return from any notice, handover, pay or contract dispute.
- I checked the current official material and the correct staff grievance channel.
- If a deadline or job consequence may be involved, I sought advice specific to the institution and my employment terms.

Questions about teachers' original degree certificates in India
Can a college keep a teacher's original degree certificate?
The UGC's 2020 public notice says employing higher-education institutions should not keep teachers' academic certificates or documents in original. AICTE's 2024–27 Approval Process Handbook addresses original degree certificates for faculty in technical institutions within its scope. The applicable source and coverage should be checked for the institution and role.
Does the AICTE handbook allow a college to inspect an original certificate?
Section 6.14(b) of the 2024–27 Handbook says an institution should not demand faculty members' original degree certificates at joining, except for verification. Section 7.4(k) separately states that, in any case, original degree certificates shall not be retained in the context it addresses. Check whether the institution and programme fall within the handbook's scope.
Does this apply to every employer or every original document?
No. The cited UGC and AICTE materials concern teachers and higher-education or technical institutions within their respective scope. They do not establish a universal rule for every employer, worker, student-admission record or type of document.
What should I do if my institution will not return my certificate?
Make a written request listing each original, when and to whom it was given, and how you can collect it. Ask for the institution's reason in writing. Keep proof of delivery, the document receipt, replies and relevant employment records, then check the institution's staff grievance process and seek qualified advice if the issue affects your job or a deadline.
Can an institution retain a certificate because I am leaving mid-semester?
The AICTE 2024–27 Handbook separately discusses faculty leaving in the middle of a semester and states that original degree certificates shall not be retained. Its academic continuity language does not resolve notice-period, pay, handover or contract disputes. Verify the current handbook and its application to the institution and programme.
General information, not legal advice. The cited education-sector materials address teachers and institutions within their stated scope. The applicable position depends on the document, institution, programme, employment terms and current directions. Check the current official text and obtain qualified advice for a specific dispute.
